Trial for Rachel Corrie
The trial for Rachel Corrie, the International Solidarity Movement (ISM) activist killed in Gaza by an Israeli bulldozer in 2003, has resumed in the Israeli city of Haifa.
On Saturday October 9, Rachel's parents Cindy and Craig and her sister Sara spoke at the AIC Cafe in Beit Sahour about the ongoing trial and their continued quest for justice for Rachel.

Supreme Court refuses challenge to use of screen to shield soldiers
Bulldozer driver and ground commander to testify in Corrie trial ::
Haifa, Israel – The driver of the bulldozer that crushed to death Rachel Corrie in Rafah, Gaza, in March 2003, and the military commander in charge of the unit on the ground that day, are scheduled to testify on Thursday, October 21 in the civil lawsuit filed by Rachel’s family against the state of Israel for her unlawful killing.

Earlier this month, the court granted the State of Israel’s request that soldiers involved in the incident be permitted to testify behind a screen to protect their identity. Lawyers for the Corrie family appealed the decision to the Israeli Supreme Court, requesting that at a minimum the family be allowed to view the soldiers, but the court refused to hear the challenge.

Consequently, the bulldozer driver will testify behind a screen. However, because the unit commander on the ground that day, Captain R.S., gave an interview that was broadcast on Israeli television in 2003, and was thus already known to the public, the presiding judge ruled that he will testify in plain view. Although disclosed during the TV broadcast, his name still remains redacted in official court records.

A third witness scheduled, known only as S.L., was driving the second bulldozer in the unit near Palestinian homes in Rafah. He will also testify from behind a screen.

The court was to hold hearings in the case on October 17-18, but postponed due to a death in Judge Gershon’s family. Therefore, additional court dates are anticipated to be added to the court calendar.

The October 21 hearing will take place between the hours of 9:00-16:00 before Judge Oded Gershon at the Haifa, District Court, 12 Palyam St., Haifa, Israel.

There were practices Weiss had observed that were not in compliance with international codes of ethics and internal law, the 1975 Helsinki Accords on the use of human subjects.11 There were acts of deviance by certain staff members. Tattoos, for example, were sometimes removed with a knife from the bodies of new immigrants to Israel, mostly Russian and Ukrainian, always suspect of nor being Jewish enough. Tattoos gave them away, and so they were treated with hostility. Penises might be circumcised, postmortem, without the knowledge or consent of relatives. The bodies of Jews and Muslims were treated differently. When Palestinians were brought in, following conflict, they were subjected to a complete autopsy, as required to produce information for the Palestinian Authority. On the other hand, the bodies of Israeli soldiers were respected, and autopsies were often discreet and partial.

YH: The law demands permissions for autopsy, but not for harvesting. I read this in the law books….There was an addendum to the law in 1981, that you should ask the permission of the family – for autopsy…. We were free to take skin from the back of legs. We took cornea. We would not take cornea from those bodies where we suspected that the families might want to open the eyelids. There are some Orthodox and some Oriental [Arab] families who open the eyelids and throw sand on top of them. We knew whom to avoid. Also we only removed the cornea, not as we did in Teleshemer [hospital], the whole eyeball. And we would close and glue the eyelids, and we would cover any place where we had removed something. And, similarly, we would take [skin] only from the back of the legs. In the beginning of the 1990s, we began to take some long bones from the legs.

The state attorneys' strike in Israel, which has been ongoing for 43 days, officially ended early Thursday morning.

Representatives of the striking state attorneys and bureaucrats from the Finance Ministry convened Wednesday evening to discuss a compromise deal proposed by Supreme Court President Dorit Beinisch. The proposal called for the attorneys to get an immediate 12% pay raise, and for the sides to enter arbitration with the former Labor Court President, American oleh Judge (ret.) Steve Adler over the attorneys' demands, which was a pay raise that is nearly double the 12% that they will initially receive.

The arbitration process will last 30 days.

The compromise deal was signed after negotiations between the two sides continued well into the night. The signing of the deal means that the attorneys will return to work on Thursday morning and start catching up on the backlog that has left many Israelis high and dry in the midst of lawsuts and paralyzed the country's legal system..

(Haifa, Israel) – In another round of last minute maneuvering, attorneys for the State in Corrie vs. State of Israel requested that testimony from their highest-ranking witness be postponed. Former Brigade Commander Colonel Pinhas (Pinky) Zuaretz, who was scheduled to testify on April 27, will not testify until May 22.

The witness was originally scheduled to testify on May 22, but on April 17, just before the court recessed for Israel’s Passover holiday, the State filed an emergency request to move Zuaretz’s testimony forward by nearly a month. Haifa District Court Judge Oded Gershon granted the government motion, without hearing from the Corrie family’s lawyers, citing availability of the witness as the main factor in his ruling.

Only after the court granted this request did the State provide Corrie family lawyers with Zuaretz’s five-page witness affidavit, though the document was signed nearly three weeks earlier.

Attorney Hussein Abu Hussein, who represents the Corrie family, opposed the State’s April 17 request and filed motion for reconsideration, citing due process violations. He indicated there was inadequate time to prepare for the witness given the expanded scope of the newly acquired affidavit and the delay in receiving it. The court denied his motion and granted the State’s request for the hearing to occur Wednesday, April 27.

However, the day before he was to appear, the State again requested a change from the court, citing the witness’ lack of availability due to a new scheduling conflict; an appointment with hired home movers. Judge Gershon rescheduled Zuaretz’s appearance for the original May 22 date. Such last-minute maneuvering is not unusual in the case.

In 2003, Colonel Zuaretz was the commanding officer of the Gaza Division’s Southern Brigade. Troops under his command were responsible for military actions on March 16, 2003, that resulted in the killing of American peace activist Rachel Corrie in Rafah. Zuaretz is the highest ranking officer called as a government witness and is, possibly, the highest ranking Israeli military officer to face cross examination in a civil suit regarding Israeli military actions against civilians in Gaza during the second intifada. His testimony is expected to shed light on the Israeli military’s failures as an occupying power to protect civilian life and property in the region.

Updated May 24: Former IDF spokesperson, Ruth Yaron, took the stand in Haifa, Israel Sunday, May 22, in what was anticipated to be the final hearing in the ongoing civil lawsuit Corrie vs. the State of Israel. However, the appearance of former Gaza Division Southern Brigade Commander Col. Pinhas (Pinky) Zuaretz was, yet again, postponed. Zuaretz’s testimony is anticipated to be more firmly set in the near future, with the State being given 15 days to respond. Yaron’s testimony focused on the International Solidarity Movement (ISM), in a weak attempt by the State to justify the military’s killing of Rachel by delegitimizing the organization’s mission of resisting the Israeli Occupation of Palestinian lands using only non-violent, direct action, methods. Rachel was an unarmed civilian, non-violently protesting against home demolitions in Rafah, Gaza, when she was killed. Yaron provided no first-hand knowledge of events, and relied heavily on second or third hand sources and hearsay. Additional information about Yaron’s testimony will be released in the future. Attending Sunday’s proceedings two officials from the American Embassy, including US Consul General Andrew Parker, as well as legal and human rights observers from the organizations Advocats Sans Frontières, Al Haq, and the Israeli Committee Against House Demolitions (ICHAD).

ISRAEL: Rachel Corrie's parents say Israel withholding evidence in wrongful-death suit - latimes.com

At the conclusion of a 16-month-long trial concerning the 2003 death of their daughter, the parents of American activist Rachel Corrie accused Israel's military of failing to turn over key surveillance video taken at the Gaza Strip field where Corrie was run over by an Israeli military bulldozer.

At a news conference Monday in Jerusalem, the Corrie family -- which is pursuing a civil lawsuit against Israel -- said the military has only provided the court with one black-and-white video, depicting events before and after Corrie was killed.

But the family says other video exists, including color images that were released by an Israel Defense Forces official and used in an Israeli television documentary. The family also obtained a third video.

"There's more video out there that needs to be turned over," said Sarah Corrie Simpson, Rachel's sister.

Israeli officials have argued in court that they have provided all the video they have.

The judge's ruling in the case is expected next April, following the submission of final written arguments by both sides. The suit was filed in 2005...
